Alleged gang members arraigned under RICO Act, could face life sentences

Several of the 21 defendants arrested across Lake County last month in “Operation Shut Down the Hustle” were arraigned in Lake County Circuit Court on Friday, pleading not guilty to charges that could land them in prison for life.

The defendants charged in the multi-jurisdictional operation are alleged members of the 4 Corner Hustlers Street Gang, and were charged under the Illinois Street Gang and Racketeer Influenced and Corrupt Organizations (RICO) Act.

A total of 13 of the defendants were arraigned Friday, facing a host of charges under RICO guidelines related to murder and trafficking of guns, heroin, cocaine and prescription drugs.

All of those arraigned Friday were charged with RICO Conspiracy and RICO Enterprise, umbrella charges that can hold gang members responsible for actions taken by the enterprise, up to and including murder. All face potential life in prison sentences at this point, officials said, but none are charged with specific murders.

The defendants were represented by a number of different defense attorneys and public defenders.

“Based on the sheer number of defendants being arraigned today, I think the court procedures went smoothly,” Assistant State’s Attorney Reginald Mathews said. “We have a lot of work ahead of us and we’re going to make sure everything gets done by the book.”

Mathews said his office is working with the Cook County State’s Attorney’s Office because of that agency’s familiarity with RICO charges and procedures.

The months-long investigation, which was conducted by local, state and federal authorities, recovered large quantities of drugs, as well as weapons and cash, authorities said. Lake County State’s Attorney Mike Nerheim, Lake County Sheriff Mark C. Curran and other officials announced the arrests during a press conference last month.

Nerheim stressed that “heroin is something you don’t have to drive to the west side of Chicago for anymore,” and asserted that the drug was coming primarily from Mexico.

The operation is the first RICO case in Lake County history, Nerheim said. He added that “anybody involved in street gang activity should know that it will not be the last.”

Evidence in the case includes video and audio recordings, phone taps and testimony from undercover agents who infiltrated the gang, officials said.

All of the arrests took place in the early morning hours of Oct. 30, and were coordinated between the FBI, the DEA, the Lake County Sheriff’s Office and the Mundelein, Zion and Waukegan police departments.

Several of the defendants are suspected of being involved in violent crimes in the area, according to prosecutors.

Those arrested allegedly hold leadership or supervisory positions in the gang, officials said.

The investigation began in January as part of the federal government’s Safe Streets Program, which targets drug-trafficking gang organizations. The FBI was the lead agency in the investigation.

All of the following defendants entered not guilty pleas Friday to the charges against them:

The Lake County Sheriff’s Office is alerting residents that any calls soliciting money for the local Fraternal Order of Police organization are not from the sheriff’s office.

Here is the full news release:

Lake County Sheriff’s Office Not Associated with FOP Telephone Solicitation Campaign

In recent days numerous Lake County residents have reported receiving telephone calls from individuals soliciting funds for the Lake County Sheriff’s Office Fraternal Order of Police.

Sheriff Mark Curran Jr. wants to make the citizens of Lake County aware that the Fraternal Order of Police is in no way affiliated with the Office of the Lake County Sheriff. Any attempt made to solicit funds via telephone, mail or in person by anyone identifying themselves as a representative of the Lake County Sheriff’s Office should not be considered legitimate.

This appears to be one of several “telephone scams” using the name of the Lake County Sheriff’s Office in an attempt to gain access to the financial information of unsuspecting victims.

Former sheriff’s officer dies while awaiting trial in jail death case

One of two former corrections officers indicted on felony charges in connection with the death of a Lake County Jail inmate in 2012 has died while awaiting trial.

Officials confirmed Wednesday morning that Robert Schlesser, 49, of Round Lake Beach, died Monday evening.

McHenry County Coroner Dr. Anne Majewski said Schlesser was pronounced dead at Centegra McHenry Medical Center at 6:15 p.m. after collapsing at home and being taken by emergency personnel to the hospital. Majewski said Schlesser died of natural causes resulting from multiple blood clots in his lungs.

Schlesser and Rodney Holmes were indicted by a Lake County grand jury for official misconduct, a Class 3 felony, in connection with the death of Eugene Gruber, who was seriously injured in the jail on Halloween 2011 and died the next spring in a rehabilitation facility.

Gruber, who was 51, was paralyzed after guards used a neck-twisting “take-down” maneuver as they struggled to change his clothes in a shower area on Oct. 31, 2011. Gruber also was sprayed with pepper spray that night for allegedly fighting correctional officers trying to process him into the jail.

During Gruber’s incarceration, security videos show, deputies hoisted him by the armpits and carried him, legs dragging, through the jail.

He was in custody on charges of disorderly conduct and criminal trespass to property.

The Grayslake man died four months later at a Chicago rehabilitation hospital where doctors had been trying to wean him off a ventilator.

As a result of Gruber’s death, Sheriff Mark Curran called for an administrative audit of the incident, which resulted in three terminations and disciplinary actions taken against 10 corrections officers. Holmes and Schlesser were among the officers terminated, according to sheriff’s office officials.

Attorney pleads not guilty to home invasion, weapon charges

An attorney from North Barrington, now being held without bond for allegedly firing shots in his ex-wife’s Hawthorn Woods home, has pleaded not guilty to home invasion and other felony charges that could carry up to 50 years in prison.

Raymond Clutts, 57, pleaded not guilty in Lake County Circuit Court Wednesday to two counts of enhanced home invasion charges, Class X felonies; aggravated discharge of a firearm, reckless discharge of a weapon, unlawful use of a weapon and criminal trespass.

He faces a range of 26 to 50 years for the home invasion charges, the most serious of the felonies he is charged with, according to Assistant State’s Attorney Steve DeRue.

Clutts was initially being held on $3 million bond in Lake County Jail, but he is now being held without bond because he is considered a danger, DeRue said.

A 50-year term is the highest sentence he could face because sentences on the other charges would be concurrent, DeRue said.

The incident began just before 7 p.m. Nov. 7, when police received a 911 call reporting several shots being fired. According to officials, Clutts fired a gun in the home several times when his wife and a child were present. No one was injured.

When officers arrived, an officer discharged his weapon but did not strike Clutts, police said, and officers then physically took him into custody. A gun was recovered.

The occupants of the house had fled to a neighbor’s residence after Clutts began firing the shots, police said. He was able to enter the home through an unlocked door.

Due to the seriousness of the incident, the Lake County Major Crime Task Force took over the investigation from Hawthorn Woods police.

Lake Zurich joins statewide effort to crack down on drunk drivers

$

Unless drivers in the Lake Zurich area are sober this holiday season, they should expect to get pulled over.

The Lake Zurich Police Department has joined the statewide effort to aggressively look for and arrest drunk drivers, as well as ticket front and back seat belt law violators, until Jan. 4, 2015.

You’ll see us out there during this highly visible enforcement period,” said Sergeant Tracey Goodyear, in a statement. “Drunk drivers will be arrested and those not observing seat belt always will be ticketed.”

Goodyear noted that DUI offenders faced jail time, loss of their driver’s license, higher insurance rates, attorney fees, court costs, lost time and work and potentially loss of employment.

According to CyberDrive Illinois, the average total cost of a DUI conviction in Illinois is $16,580—that total includes $4,500 for high-risk insurance over the course of three years; $2,000 for an uncontested plea and hardship driving permit; $3,600 in court costs; a loss of four weeks’ worth of income—or $4,230—due to jail or community service, and remedial education classes; $250 for substance abuse classes and counseling; $580 for a driver’s license reinstatement; and $1,420 for a Breath Alcohol Ignition Interlock Device.

It is additionally important to note that any parent or guardian who knowingly allows those under the age of 21 to drink alcohol on their property is guilty of a Class A misdemeanor, which is one step below a felony offense. Should somone get hurt, as a result, it is a Class 4 felony.

In 2012, more than half of all traffic fatalities that occurred on New Year’s Day involved a drunk driver, according to Mothers Against Drunk Driving (MADD).

An 18-year-old Des Plaines man told police that he repeatedly stabbed his date — puncturing both of her lungs — while outside a Deer Park movie theater because she “annoyed him,” according to the Lake County Sheriff’s Office.

Daniel J. Dion was charged Friday with attempted murder and aggravated battery charges and was being held without bond in Lake County Jail.

Katherine M. King, 24, of Vernon Hills remained in critical condition after she was stabbed more than 20 times Thursday night, police said.

She had cuts to her face and neck as well as punctures to both lungs, and was being treated in the intensive care unit at Northwest Community Hospital in Arlington Heights.

Dion was arrested shortly after officers arrived about 8:45 p.m. to the Century Theater at 21600 W. Field Parkway in Deer Park, according to a police news release.

Authorities said Dion admitted to police that he attacked King while inside her vehicle.

Dion told investigators “he woke up in the morning with the intent to kill King because she annoyed him,” according to the police news release.

Katie Dion, who identified herself as Daniel’s twin sister, said her brother has struggled with anger and behavior issues for years. Still, she was shocked to learn that he was charged with such a violent act, and said that she hopes that it results in getting him help.

“That could have been me,” said Dion, adding that she moved out of the family’s house five months ago because of family tension. “I feel really horrible for that girl.”

Lake County Undersheriff Ray Rose said Dion arranged to meet with King “under the guise of going on a date … to the movie theater.”

Rose said the attack started as the pair sat in a car in the parking lot but that King “was able to run into the movie theater to get help.”

Rose said the suspect and the victim were dating, though a close relative of King, who did not want to be identified, described the two as friends.

Dion attempted to run away from the scene after the stabbing, but was spotted by theater employees and “was covered in blood so it was easy to find him,” Rose said.

King was in critical but stable condition Friday after undergoing surgery Thursday night, Rose said.

Investigators do not expect to be able to speak with her for a few days because of her condition, he said.

The relative of King said she is an intensive care and is breathing through a tube but will “be all right.”

King went to Argo Community High School in south suburban Summit, the relative said.

The family member called King a “good kid.” She enjoys singing and has frequently posted videos on Facebook showing her singing her own compositions and popular tunes.

Katie Dion said her brother attended various alternative schools before finishing high school through an online program. She said he became more reclusive in recent years.

Dion’s next court date is scheduled for Feb. 2.

Double-jury case is Lake County’s first in nearly three decades

Prior to this week, the last time the double-jury system was used to hear a case in Lake County Circuit Court was 28 years ago.

William Fillyaw, 37, and Johnny Parker, 31, are being retried on first-degree murder and attempted murder charges after their 2009 convictions were reversed at the state appellate court level for trial errors.

Their cases are technically severed and two separate juries are hearing the trial, sometimes in court separately and sometimes at the same time. The two-jury method is used in cases where considerable duplication can be avoided but certain evidence pertaining to one defendant is not appropriate for the jury of the other defendant to hear.

For example, two sets of opening arguments were held Monday, each before a different jury, in the cases against Fillyaw and Parker. But then both juries were seated in court together as witness testimony began.

“Logistically, they are incredibly difficult to put on,” said Judge James Booras, who, along with Judge George Strickland, prosecuted Lake County’s last double-jury trial when both were assistant state’s attorneys.

“Managing two juries in a courtroom at the same time is hard. Managing one is hard,” Booras said.

In January 1987, Booras and Strickland successfully prosecuted a local husband and wife couple charged with major drug distribution. Booras remembered that the case demonstrated the difference between every jury.

One jury in that case reached a guilty verdict at about 9 p.m., while the other did not reach the same verdict until roughly 3 a.m.

“They do avoid duplicity but a great expense,” Booras said.

He referenced the time and logistics involved, from selecting twice as many jurors and alternates to keeping the juries completely separated when they are not in court throughout the length of the trial.

Former Chief Judge Fred Foreman said the double -jury process, used more frequently in Cook County, is helpful in cases with similar or the same charges against two defendants because professional witnesses such as doctors and detectives only need to be scheduled once.

“You save time, but they can be very challenging,” said Foreman, whose extensive legal background includes terms as a public defender, a prosecutor, Lake County State’s Attorney, U.S. Attorney for Chicago, a felony judge and finally chief judge of the Circuit Court.

“A jury trial is like trying to put on a production or play,” Foreman said. “In this case you have twice as many jurors. But it can be real efficient.”

State’s Attorney Michael Nerheim declined to comment Tuesday on the decision to try Fillyaw and Parker with a double jury because the trial is still under way.

In the current case, prosecutors allege that Fillyaw, armed with a shotgun, and Parker, armed with a handgun, kicked open a door and began shooting at people in a North Chicago apartment. Lasondra Shaw, 28, was killed and two men suffered serious injuries from gunshot wounds.

The alleged home invasion occurred in the early morning hours of June 29, 2007.

Fillyaw and Parker were convicted in 2009 and sentenced to 55 years in prison, but the convictions were reversed in an April 2011 Illinois Second District Appellate Court ruling citing trial errors. The case was then remanded back to circuit court, leading to a decision by the Lake County State’s Attorney’s Office to proceed with a retrial.

To prepare for the retrial, Courtroom 201 was temporarily reconfigured, including the placement of two additional rows of seats in front of the usual jury gallery to make room for more jurors. An additional counsel table was also added to accommodate two defense teams as opposed to one.

Due to the the complexities of the case, it is expected the trial will continue beyond this week.
